Conditions & Regulations


1. RoadRunner Tours
RoadRunner Tours is the trading name of David Butcher GbR , a company registered at Prälat-Lewen-Strasse 30, 53819 Neunkirchen, West Germany .

2. Booking Form & Deposit
By signing the Booking Form for any tour, you agree on behalf of all persons named on the Booking Form to the conditions detailed on this page and on the Booking Form . It will be deemed that these conditions are accepted by all members of your party, unless I ( RoadRunner Tours ) am informed in writing within 5 working days of the Booking Form being received.
Your completed and signed Booking Form must be accompanied with the appropriate deposit (the amount is shown on the Booking Form ), plus the Personal & Medical Travel Insurance and Vehicle Breakdown & Repatriation Service premiums (if applicable). This sum is your only payment commitment until eight weeks prior to the start of the Tour, when the balance of monies becomes due. I will send you a Confirmation/Invoice (showing the details of your booking and the outstanding balance of monies due) within fourteen days of receiving your completed Booking Form and deposit, and your booking is not confirmed until the date shown on the Confirmation/Invoice (which is the date that this contract comes into force). If I am unable to confirm your booking, for whatever reason, I will refund your deposit in full.

3. Booking Form & Deposit
The outstanding balance of monies due must be paid no later than eight weeks before the start of the Tour, and the date for final payment will be shown on the Confirmation/Invoice. No reminders will be sent out. If you return the Booking Form less than eight weeks before the start of the Tour, then the full amount is due at the time of booking. If the balance is not received by the due date for whatever reason, I reserve the right to treat your booking as cancelled by you, and cancellation charges (as detailed below) will be made.

4. Cancellation
The cancellation of a booking is only effective once I have received notification in writing from the person who signed the Booking Form . In order to help cover the expenditures of RoadRunner Tours , the charges for the cancellation fee are set out in the table below:

5. Changes to Booking
In keeping with my philosophy of providing the best possible service, if you need to make any changes to your booking, I will do our utmost to assist you. However, I will make small administrative charge (of Euro 15,- / £ 10,- per person) to cover my expenses. All requests for amendments must be made to me in writing, and if agreed, written approval will be issued by me. If you change your booking within six weeks of the start of the Tour, I reserve the right to invoice the cancellation charges as detailed above. If a booking amendment involves a change of name, insurance premiums may not be transferrable.

6. Cancellation of Booking by us
A minimum number of participants are required, in order for me to run any of my Tours. It may be necessary for me to cancel any Tour in exceptional circumstances, and I must reserve the right to cancel your Tour at my absolute discretion. In this unlikely event, you will be offered a place on an alternative Tour (if available) or a full refund of all monies paid. If I must cancel the Tour within eight weeks of the start date, you will additionally receive compensation as set out in the table below (unless the cancellation is due to circumstances beyond my control):

7. If I change your booking
It is unlikely that I will have to make any changes to your booking, but the arrangements must be made several months in advance, and later changes may become necessary. I must, therefore, reserve the right to make any changes to the arrangements described in this web site. Usually changes are made because I have become dissatisfied with the service supplied by a third party, such as a hotel or ferry company, but may be enforced upon me by the third party themselves. It is not always possible to confirm the name of the hotel to be used at the time of booking. However all hotels used will be at least of the standard advertised. If a major change becomes necessary, I will inform you as soon as I can. A major change is one that involves a change of start time of more than 12 hours, a change of destination (i.e. country), or offering accommodation with a lower official classification than that advertised. Please note that a change of air or sea port is NOT classified as a major change, nor is a change of cross-Channel arrangements from ferry to Le Shuttle, or vice versa. Should you decide not to accept the change, I will refund all monies paid plus compensation or a credit towards the cost of another RoadRunner Tours holiday on the above scale. Compensation payments do not apply to changes because of reasons of force majeure, or due to circumstances outside of my control. I reserve the right to make changes to my advertised itineraries because of traffic or weather conditions, diversions, any other operational reasons, or other reasons of force majeure, including any event which I or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such circumstances include war or threat of war, civil strife, terrorist activity, adverse weather conditions, natural or nuclear disaster, industrial dispute, fire and all similar events outside our control.

8. My Responsibility for your Holiday
I accept responsibility for the standard of holidays that I provide and undertake to maintain such standards in a manner commensurate with the cost of the holiday. I accept responsibility for the acts/omissions of our sub-contractors and suppliers for the services which I have contracted to provide. I have taken all reasonable and proper care to ensure that suppliers such as hotels, coach and ferry companies are reputable concerns and that they comply with the local and national laws of the country in which they supply their services. Any claims arising from such acts/omissions shall be limited to the basic price of the holiday for the person(s) affected, except in respect of loss and/or damage to luggage and/or personal possessions (including money), where my liability is limited to Euro50,- / £35,- per person affected, as it is assumed that you have taken out adequate insurance cover. If you or any member of your party suffer illness, injury or death arising from the negligence of our suppliers in the provision of services which I have contracted to provide, I will accept responsibility providing they were acting within the scope of, or in the course of their employment when the accident occurred. If you or any member of your party suffer illness, injury or death through misadventure during the period of the holiday, arising out of an activity which does not form part of the holiday, I may, at my absolute discretion and where appropriate, offer assistance to you. This includes advise, guidance and initial financial assistance up to the limit of Euro7.500,- / £5.000 in total to assist in the bringing of legal action, provided that such assistance is requested within 90 days from the date of misadventure. In the event of a successful claim for costs against a third party or suitable insurance policy is in force, I will be entitled to recoup the costs I actually incur from you. In the event of a claim against me, I reserve the right to claim in your place against the person or organisation responsible for causing the illness or injury in respect of carriage by air, by sea or any other area covered by International Convention, and my obligations and abilities shall be limited in the manner provided by the relevant International Conventions.

9. German Law
Any claim under this agreement should be subject to German Law and all proceedings shall be within the exclusive jurisdiction of the German Courts.

10. Rights of Refusal and Indemnity
I expect all of our clients to have consideration for their fellow passengers. In the event of any client behaving in such a way as is likely, in my opinion or the opinion of any person in authority, to cause offence, danger, damage or distress to others, I reserve the right to terminate that person's holiday arrangements. In this event, my responsibility for their holiday will thereupon immediately cease and I will not be liable for any costs or expenses incurred by them as a result. Full cancellation charges will apply and I will be under no obligation whatsoever for any refund, compensation or loss you may incur. If your actions, or those of any member of your party, cause damage to the accommodation in which you are staying or to the vehicle, train, ship or aircraft in which you are travelling, or cause delay or diversion to any means of transportation, you agree to fully indemnify me against any claim (including legal costs) made against me by, or on behalf of, the owners of such accommodation or the operator of such means of transportation.

11. If you have a Complaint
In the unlikely event that you feel dissatisfaction with any aspect of your holiday arrangements, I ask you to bring this to my attention at the time (together with the supplier of the services in question, if applicable), so that the matter may be resolved straightaway. If the matter cannot be resolved on the spot please ask me for a Holiday Report Form which you must immediately complete. One copy will be given to you as your record, and one copy will be retained by myself. Please follow up your complaint in writing within 28 days of your return from holiday. I undertake to deal with your complaint promptly, carefully and fairly, but I regret that I cannot accept liability in respect of any claim of which I am not notified entirely in accordance with this clause. Disputes arising out of, or in connection with, this contract which cannot be amicably settled may be referred to arbitration, if the customer so wishes, under a special Scheme which, although devised by arrangement with the Association of British Travel Agents, is administered quite independently by the Chartered Institute of Arbitrators. The scheme provides for a simple and inexpensive method of arbitration on documents alone with restricted liability on the customer in respect of costs. Full details will be provided on request. The Scheme does not apply to claims for an amount greater than £1.500 per person. There is also a limit of £7.500 per booking form. Neither does it apply to claims which are solely or mainly in respect of physical injury or illness, or the consequences of such injury or illness. The rules of the scheme provide that the application for arbitration must be made within nine months of the date of return from the holiday, but in special circumstances it may still be offered outside the period.

12. Declaration
It is the responsibility of our clients to ensure that any vehicle that they have entered is correctly registered, currently licensed, in possesion of a valid MOT (or appropriate roadworthiness) certificate, and fully insured for use within the countries to be visited on the RoadRunner Tour in question. It is adviseable (and in some countries obligatory) to carry a valid vehicle Insurance Green Card. I recommend taking a photocopy of vital paperwork with you on the Tour (MOT certificate, vehicle V5 registration document, Passports, credit cards, driving licence, etc. ), in case of loss or theft.
The Tour will take place on public or private land, and no part of the event is competitive, and there will be no timekeeping or pacemaking (unless otherwise specified on the Booking Form ).
All participants accept full responsibility for their own actions, and the condition of their vehicle entered.

13. Insurance
Although an executive from RoadRunner Tours will accompany the participants on Tour, no technical or medical support is provided. Therefore it is strongly recommended that all participants arrange their own insurance cover, for both Personal & Medical Travel Insurance plus Vehicle Breakdown & Repatriation Service. Participants are expected to carry reasonable spares and tools (including such - in some countries obligatory - items as a warning triangle, first aid kit, spare bulb set, spare fuel etc.)

14. Souvenir Rally Plate, Identification Tag and Route Book
Two traditionally-styled souvenir Rally Plates will be issued to each vehicle prior to the start of each Tour. These must be prominently and securely fixed to the front and rear of the vehicle. Additionally, a smaller credit-card size self-adhesive Identification Tag will be supplied to each vehicle prior to the start, and this must be stuck to the windscreen - this is to assist identification of Tour participants. One detailed Route Book (and maps, where appropriate) will also be supplied to each vehicle prior to the start of each Tour.
Shortly after the Tour has finished, a souvenir photograph will be sent to the registered Driver of every vehicle. Additional copies may be ordered from RoadRunner Tours at an agreed price - current rates will be provided on request.

15. Loyalty Bonus
If you have already been on a RoadRunner Tour, you are eligible for a 5% discount off your next RoadRunner Tour , as a loyalty bonus. If two tours are booked simultaneously, this discount applies to both tours.
This loyalty bonus increases to a 10% discount off all RoadRunner Tours booked after the fifth tour.
Approved Car Clubs may also be eligible for the above bonuses, if the appropriate numbers of members book at the same time for any Tour - please apply to RoadRunner Tours for further details.
